INOVAM Terms and Conditions
By placing an order, You agree to be bound by the terms and conditions set out herein. Please make sure You have read and understood these terms and conditions before placing Your order.
Please note that INOVAM is an independent reseller and is not affiliated with, endorsed by, or authorized by Apple Inc.
1- Definitions
- “INOVAM” “We” “Us” “Our” refer to INOVAM LIMITED (BRN = 78281414 ) Registered address (No. 5, 17/F Strand 50 50 Bonham Strand Sheung Wan Hong Kong).
- “Customer” “You” refer to any person placing an order on the INOVAM website.
- “these Terms” refers to the INOVAM terms and conditions.
- “Device” refers to refurbished iPhones sold on the website.
- “Day” and “Days” refer to business days, excluding weekends and public holidays unless explicitly stated as “calendar day”.
- “IMEI” refers to the International Mobile Equipment Identity.
- “FMI” refers to find my iPhone feature in Apple iPhones.
- “iCloud” refers to Apple’s cloud service linked to an Apple ID, including the “Find My iPhone” feature.
2- Customer Acceptance of Terms
By placing an order on INOVAM’s website, You agree to be bound by these Terms.
You are obliged to give Your full contact information, including Your name, billing and shipping address, active telephone number and valid email address. You are solely responsible for the accuracy of the information you provide to INOVAM. Any and all costs caused by incorrect contact information is to Your sole liability.
By placing an order on INOVAM’s website, You confirm that You are of the required legal age to be bound by these Terms and place an order on INOVAM’s website.
3- Products
INOVAM specializes in selling refurbished iPhones.
As Our goal and ambition is to provide high quality refurbished iPhones at competitive prices and accessible financing options, the iPhones pass through rigorous checks and professional quality control done by professionals before being delivered to Our customers.
INOVAM grades the iPhones based on aesthetic condition and performance. When placing an order, You will choose the desired model, color, memory capacity, grade and version (US, EUR) You wish to purchase.
The iPhones are refurbished, thus INOVAM does not guarantee that the original splash, dust and water resistance condition (IP67 or IP68 certification) remains valid.
We make all reasonable efforts to accurately explain the attributes of Our products, including their condition and model variables.
All parts used in the refurbishment process are high quality and CE compliant. Our goal is to provide refurbished iPhones as close as possible to brand new ones.
4- Prices
The prices of the products include delivery costs and value added tax (VAT) where applicable, in accordance with applicable tax law.
Prices are displayed in installment form (three equal payments) alongside the total price of the products.
The total price including delivery costs and applicable taxes, is always clearly indicated before order confirmation.
INOVAM shall not be liable for any misunderstanding arising from a failure to review the total price displayed before completing the order.
INOVAM reserves the right to cancel an order in the event of a clear and material error, including but not limited to a pricing error where the price of the product clearly and significantly deviates from its normal price, such that an average consumer would reasonably recognize the error. In such cases, the customer will be informed without undue delay and any amounts paid will be refunded.
5- Payments
INOVAM accepts the following payment methods :
- Mastercard
- Visa
- Paypal
- American Express
- Google Pay
- Apple Pay
- Klarna
The terms and conditions of each of these payment providers shall apply to purchases made using their services. INOVAM reserves the right to refuse and/or cancel any order in the event of payment authorization failure, suspected fraud, or other payment-related issues.
If the order has already been shipped or delivered and payment is subsequently reversed, declined, or not received, INOVAM reserves the right to require the return of the products at the customer’s expense, or to take any other action permitted by applicable law.
Any amounts successfully paid by the customer will be refunded in accordance with applicable law.
6- Delivery
The customer is responsible for providing INOVAM with correct information for successful delivery when placing the order, including the address and phone number in the correct format.
The order processing time is on average 1-2 Days after the order confirmation has been sent. Delivery times may vary depending on the destination country.
The delivery times are estimates and are dependent on the delivery service provider. INOVAM aims to process all orders in the time frame above where possible. However, INOVAM shall not be liable for any delivery delays that are beyond its reasonable control, including but not limited to, incorrect information provided by the customer when placing the order, strikes, weather conditions, epidemics, quarantines or shortages of transportation fuel, energy or labor.
In the event that a customer receives an incorrect or damaged product, the customer is required to inform INOVAM about this error as soon as reasonably possible after receiving the products. INOVAM shall assess each case individually. The customer may be required to provide reasonable evidence, including photographs or other relevant information such as IMEI, to support the claim.
Notifying INOVAM is to be done via email or submitting a request via the Contact page and providing the required contact details and a clear statement of the error.
Where the incorrect delivery or damage is attributable to INOVAM, INOVAM will bear the costs associated with the return and replacement in accordance with applicable law.
When an investigation determines that the damage was caused by the customer, or that the returned product is incomplete, altered, or not the same product originally delivered, INOVAM reserves the right to refuse the claim or to deduct an appropriate amount to reflect the diminished value of the product, in accordance with applicable law.
7- Right of Withdrawal
INOVAM provides the customer with a 15 calendar day right of withdrawal from the date of receipt of the products.
For a full refund provided by INOVAM, returned products must be in the same condition as delivered, except for handling strictly necessary to inspect the product.
Products with signs of use, damage, or alteration beyond such inspection may result in a reduction of the refund to reflect loss of value.
Products that are significantly damaged, incomplete, or altered will not be accepted and will be returned to the customer without refund.
After the refund is accepted, INOVAM will issue the refund using the same payment method used to make the payment without undue delay and no later than 14 calendar days after receiving the returned products or proof of return.
In exceptional circumstances, such as public holidays or technical processing delays, the refund process may take slightly longer. If INOVAM is unable to issue the refund using the same payment method used to make the payment, the refund will be issued using an alternative payment method subject to the customer’s consent, in accordance with applicable law.
The customer is responsible for packing the products in a careful and protective manner before sending them to INOVAM.
Returned products must be sent to the address provided by INOVAM following return approval.
Return shipping and handling costs are borne by the customer when exercising the Right of withdrawal.
The customer is responsible for the products until they have been delivered to INOVAM.
To exercise the right of withdrawal, the customer must notify INOVAM of their decision by submitting a request via the Contact page and providing the required contact details and a clear statement of their decision to withdraw. INOVAM will process the request without undue delay and in accordance with applicable law.
The customer must ensure that Find My iPhone (FMI) feature has been disabled and that the device is removed from their iCloud account before sending it to INOVAM.
If a returned device is received with “Find My iPhone” enabled or still connected to an Apple iCloud account, the return will not be accepted. In such cases, the device will be returned to the customer without refund. The customer may disable the feature and initiate a new return request in accordance with these Terms.
8- Statutory Warranty and Liability for Defects and Lack of Conformity.
The customer benefits from a statutory warranty of twenty-four (24) months under applicable law, including the legal guarantee of conformity.
The statutory warranty covers defects and non-conformity existing at the time of delivery that are not caused by the customer.
During the first twelve (12) months after delivery, defects are presumed to have existed at the time of delivery, unless INOVAM demonstrates that the defect was caused by misuse, accidental damage, or other causes attributable to the customer.
From the thirteenth (13th) month up to twenty-fourth (24th) month following delivery, the customer may be required to demonstrate that the defect or lack of conformity existed at the time of delivery, in accordance with applicable law.
To exercise statutory warranty, the customer must notify INOVAM within 24 months from the delivery date.
Notifying INOVAM is to be done via email or submitting a request via the Contact page and providing the required contact details and a clear description of the claim.
INOVAM shall assess each case individually. The customer may be required to provide reasonable evidence, including photographs or other relevant information such as IMEI, to support the claim.
9- Limitation of Liability
Nothing in these terms shall exclude or limit INOVAM’s liability where such exclusion or limitation would be unlawful under applicable law, including statutory consumer rights.
Subject to the foregoing, INOVAM shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of profits, loss of business, loss of data, or loss of opportunity, arising out of or in connection with the purchase or use of the products.
INOVAM shall not be liable for any failure or delay in the performance of its obligations where such failure or delay results from events beyond its reasonable control, including but not limited to natural disasters, strikes, epidemics, governmental actions, or disruptions to transportation or logistics services.
Except where mandatory statutory liability applies, INOVAM’s total liability in connection with any order shall be limited to the total amount paid by the customer for the relevant order.
This limitation of liability does not affect the customer’s statutory rights, including the statutory warranty and the legal guarantee of conformity under applicable law.
In the event of unforeseen stock unavailability or other circumstances beyond INOVAM’s reasonable control occurring before delivery, INOVAM reserves the right to cancel the order. In such cases, the customer will receive a full refund of all amounts paid without undue delay and no later than fourteen (14) calendar days after the customer is informed of the cancellation.
The characteristics of the products, including their cosmetic condition and technical specifications, are described on the “Our iPhones” page, with each product detailed in its respective section. By selecting the condition, model, and the version of the product, the customer expressly acknowledges and accepts the described characteristics.
INOVAM shall not be responsible for any misunderstandings or dissatisfaction resulting from the customer’s failure to review the product characteristics as described, without prejudice to the customer’s statutory rights under applicable law, including the right of withdrawal.
10- Changes to Terms and Conditions
INOVAM reserves the right to amend or update these Terms and Conditions from time to time, to reflect changes in legal requirements, business practices, or operational needs.
Any changes will take effect from the date they are published on the website and will not apply retroactively to orders already placed and accepted prior to the effective date of such changes.
Customers are encouraged to review the Terms and Conditions periodically. Continued use of the website after changes are published constitutes acceptance of the updated Terms and Conditions.
11- Applicable Law and Dispute Resolution
These Terms and Conditions are governed by and construed in accordance with the applicable laws.
In the event of a dispute arising out of or in connection with these Terms and Conditions or the purchase of products, the customer is encouraged to contact INOVAM in the first instance to seek an amicable resolution.
If no amicable resolution can be reached, the customer may use the European Commission’s Alternative Dispute Resolution (ADR) platform to resolve disputes arising from online purchases.
INOVAM is not obliged to participate in alternative dispute resolution proceedings and does not commit to doing so, unless otherwise required by applicable law.
Nothing in this section shall limit or deprive the customer of mandatory rights or protections afforded under applicable consumer protection laws.
